Website "website" – a website for ordering passenger transport services and concluding passenger transport contracts,

by users and enables online payments.

Passenger – a person or persons using the passenger transport service along with luggage and accepting the following regulations and is a person representing the person ordering the service who has concluded a passenger transport contract.

Driver – a licensed taxi driver or other driver with appropriate authorization to drive a taxi or bus vehicle, who may perform transportation under a separate cooperation agreement.

Contractor – WarsawBusTravel.pl Sp. z o.o. is the entity that accepts the order for execution and assigns it to the driver responsible for the proper performance of the service.

Passenger transportation service – transport service provided to Passengers by Drivers using a taxi (within the meaning of Art. 2

point 43 of the Act of 20 June 1997 - Road Traffic Law, Journal of Laws of 2005, No. 108, item 908, as amended, in connection with Art. 4 sec.

1Act of 06.09.2001 on road transport, Journal of Laws of 2007, No. 125, item 874) or vehicles with more than 9 persons

in accordance with applicable law (Occasional transport – passenger transport that does not constitute regular transport, transport

regular special or shuttle transport;

§1

General comments regarding the services offered by WarsawBusTravel.pl Sp. z o.o.

In accordance with the following terms and conditions, when using the website Wynajem-autokarow-warszawa.pl, the Passenger orders a passenger transportation service by completing the form and clicking the "ORDER" button or by phone at +48510230710, thereby expressing their willingness to enter into a passenger transportation agreement with the Contractor. Information, including the Passenger's data, is transferred to the Driver, who confirms their willingness to perform the service by confirming the order via email or by phone. The Passenger can also contact the person coordinating the transportation at any time at +48510230710 and obtain contact information for the driver performing the transportation. For the purpose of fulfilling the agreement, the Driver entrusted with the transportation is obligated to arrive at the location indicated by the Passenger, provided that a safe and road-legal stopping point is available. The passenger transport contract is concluded by submitting declarations of will: the Passenger after pressing the "Send Order" button, confirmation via e-mail or telephone, which confirms the order for the service and at the same time accepts all the conditions of transport previously agreed.

§2

Fees and payments

  1. Wynajem-autokarow-warszawa.pl does not charge the Passenger any fees for ordering a ride and not using the service in the event of cancellation of the service with sufficient advance notice, i.e. if the transport service has not been ordered for execution.
  2. In the case of a special reservation, i.e. ordering a selected vehicle, color, brand, unmarked "TAXI" or availability for a longer period, a reservation fee of 50% of the order value will be charged.
  3. The fee will not be charged in the event of a change in the order completion date, but only when the contractor confirms the possibility of completing the order.
  4. Based on the concluded passenger transport contract between the Passenger and the service recipient, the service is settled based on arrangements made via e-mail or telephone.
  5. Payment methods include: online payment (before the trip), prepaid transfer, cash before or immediately after the trip, and payment by credit or debit card upon prior arrangement with the operator. Bank transfers based on an invoice are available to existing partners.
  6. Wynajem-autokarow-warszawa.pl may implement a different form of settlement with the service requester. In the case of long-term orders requiring significant fleet and employee involvement.
  7. The passenger may demand reimbursement of the difference in costs incurred if the order is not fulfilled within the specified time, on the specified route and with the specified number of passengers, using transport similar to the one ordered, if the reason lies with the service recipient and there are no so-called force majeure events.

Withdrawal from the service contract


1. Zgodnie z ustawą z dnia 30 maja 2014 r. (Dz.U. 2014 r. poz. 827 ze zm.) Konsument, który zawarł umowę na odległość, może w terminie 14 dni kalendarzowych odstąpić od niej bez podawania przyczyny i bez ponoszenia kosztów, dla umów zawartych 21 dni lub więcej przed realizacją usługi. Odstąpienie od umowy bez podania przyczyny może nastąpić najpóźniej na 7 dni przed realizacją zamówienia. Do zachowania terminu wystarczy wysłanie stosownej informacji drogą elektroniczną na adres biuro@wynajem-autokarow-warszawa.pl, jak również poprzez kontakt telefoniczny pod numerem +48 510230710, w tym celu prosimy o przygotowanie informacji mających kiedy i skąd miała zacząć się usługa.

2. If the Ordering Party has paid an advance or made a full payment for a future service and has exercised their right to withdraw from the service agreement, the refund will be made via the same payment method or by bank transfer to the bank account number specified by the Ordering Party, which should be sent electronically to biuro@wynajem-autokarow-warszawa.pl or via text message to +48510230710.

Complaints

1.The provisions of this section apply to the concluded transport service contract concluded in writing and do not provide for detailed procedures for reporting and considering complaints.

2. The User or the Ordering Party may file a complaint if the service performed was not in accordance with the arrangements or was not performed properly by WarsawBusTravel.pl sp. z o.o.

3. Complaints regarding the method and quality of service provision must be reported by the User or the Ordering Party to Wynajem-autokarow-warszawa.pl in the following manner:

  2. sending to the email address: biuro@wynajem-autokarow-warszawa.pl

4. A properly filed complaint should contain at least the details of the User or Ordering Party submitting the complaint (name, surname, address, date of service provision, from where and to where) and should indicate any irregularities in the service provided.

5. The subject of the complaint and its validity are assessed by the company's management board or an authorized representative of WarsawBusTravel.pl Sp. z o.o. within 14 days of receiving the complaint.

6. If the complaint is justified, after analysis with the User, a monetary compensation amount up to the value of the order or a discount on subsequent services will be determined.

7. WarsawBusTravel.pl sp. z o.o. is obliged to pay the agreed compensation within the time limit agreed with the User or the Ordering Party, but no later than 1 year.

8. A complaint may be deemed unjustified if the irregularities in the performance of the service occurred not due to the fault of WarsawBusTravel.pl sp. z o.o. or random causes.

§3

General rights and obligations of the Passenger

  1. Before using the services of the Wynajem-autokarow-warszawa.pl portal, passengers are required to read the regulations located at www.wynajem-autokarow-warszawa.pl. When placing an order, the passenger is required to provide truthful personal information about the passenger or the person requesting the transport (first name, last name, phone number, or email address) and provide direct contact information for the passenger responsible for coordinating the transport. Ordering Transport constitutes acceptance of the regulations and consent to the processing of the passenger's or the person requesting the transport provided during the ordering process.
  2. The Passenger is obliged to provide complete and truthful personal or company data required by Wynajem-autokarow-warszawa.pl and to check and update them without any requests from Wynajem-autokarow-warszawa.pl.
  3. The passenger is obliged to use the transport in accordance with its intended purpose and in accordance with the law and generally accepted principles.

§4

Responsibility of rental-autokarow-warszawa.pl

  1. Wynajem-autokarow-warszawa.pl is not responsible for the authenticity, accuracy, or completeness of data transmitted via the website between the Passenger and the Contractor. Wynajem-autokarow-warszawa.pl is also not responsible for ensuring that the data is received in a timely manner (by both the Passenger and the Contractor).
  2. Wynajem-autokarow-warszawa.pl is not responsible for any loss of order-related data on the Ordering Party's devices or correspondence. Securing this data is the Ordering Party's responsibility.
  3. Wynajem-autokarow-warszawa.pl is not responsible for the content and links to websites belonging to third parties and posted on the website www.wynajem-autokarow-warszawa.pl without the knowledge of the site owner.

§5

Personal data protection

  1. All personal data provided by the Passenger using the order panel (name, surname, e-mail address, telephone number and location) will be stored and processed in accordance with the provisions of the Personal Data Protection Act of 29 August 1997 (Journal of Laws of 2002, No. 101, item 926, consolidated text, as amended).
  2. All personal data of the Passenger collected by Wynajem-autokarow-warszawa.pl are stored and processed in a manner necessary for the proper execution of the order.
  3. Initiating the order fulfillment process constitutes acceptance of all provisions of the following regulations, along with consent to the collection, storage, and processing of the Passenger's personal data, as well as consent to the disclosure and transfer of data such as name, surname, telephone number, and location to individual Drivers fulfilling the order, who consent to the provision of passenger transportation services. The Passenger may withdraw their consent to the use and processing of their personal data at any time in writing, which will terminate the order fulfillment process.
  4. The passenger consents to the collection and use of their personal data for billing purposes. This data is necessary for the proper operation of the website and is used solely for the proper settlement of contracts concluded by WarsawBusTravel.pl Sp. z o.o. The collected data is for identification purposes and includes information on the telecommunications media used, start and end times, and the overall duration of the order (use of means of transport).
  5. The Passenger consents to the disclosure of his/her personal data for purposes related to the fulfillment of the provisions of these regulations for the use of the website Wynajem-autokarow-warszawa.pl or to the pursuit of legal claims related to the implementation of these regulations.
  6. Consent to the storage and processing of data is voluntary.
  7. The passenger has the right to view and correct his or her data.
  8. Please send any information regarding the use of personal data, as well as access to their content, how to update or withdraw consent to their use via the contact form on the website www.wynajem-autokarow-warszawa.pl or in writing to the current address indicated on this website.

§6

User Rating System

  1. Passengers are entitled to make an honest assessment of the services provided by Drivers, both the Driver and the vehicle. Passengers agree to provide only truthful information.
  2. The Passenger consents to the publication of ratings in the TripAdvisor.com application and on the website www.wynajem-autokarow-warszawa.pl.

§7

Final provisions

  1. If any provision of these Terms and Conditions (or part of any provision) is found by a court or other competent authority to be invalid, unenforceable, or illegal, the remaining provisions will remain in full force and effect and will be deemed binding. The invalid, unenforceable, or illegal provision will be replaced by another provision that best meets the economic and commercial purpose of using the order form.
  2. Wynajem-autokarow-warszawa.pl reserves the right to change the content of these Terms and Conditions. The new Terms and Conditions are effective from the date the new version is posted on the website www.wynajem-autokarow-warszawa.pl.
  3. Passengers have the right to submit written objections to changes to these regulations within seven days of their publication. Submitting an objection will automatically result in termination of their rights to use the ordering panel.
  4. The law applicable to these regulations will be Polish law.

General terms and conditions of the service
„Mobile payments”

Definitions

By agreeing to the terms below, the Passenger accepts that WarsawBusTravel.pl Sp. z o.o. may charge the Passenger's debit card or bank account (e.g. credit card, Pay Pal account, electronic debit or other payment option) indicated by the Passenger in the order panel during the payment process for the passenger transportation service, for the amount confirmed by the Passenger.
The user has the option of enabling the automatic collection of funds for the service using the default payment method, without having to confirm the transaction amount each time.

The following terms and conditions apply in conjunction with the Terms and Conditions of Use upon confirmation of the order by the Passenger.

§1

Subject of the service

  1. Wynajem-autokarow-warszawa.pl offers cashless payment options, up to the amount specified by Wynajem-autokarow-warszawa.pl, for passenger transportation services ordered via the order panel or confirmed electronically by phone. The fee is collected from the User via electronic direct debit, credit card, or mobile payment systems.
  2. When registering for the mobile payment service, the Passenger has the option to choose their preferred cashless payment method, which can be changed or deleted at any time, except during the journey.
  3. When paying via PayPal, the User will pay the amount confirmed during the payment process without disclosing their PayPal account to the transportation service provider. According to PayPal's terms of use, the Passenger is required to open a PayPal account and may be charged an additional fee for using this service. PayPal reserves the right to debit the User's PayPal account in varying amounts during the payment process.

§2

Passenger Obligations

  1. Passengers have complete freedom in choosing their payment method. Payment can be made in cash or by card to the Driver, or by one of the cashless methods in accordance with §1 paragraph 1.
  2. In the case of non-cash payment, the gross amount is assumed to be paid.
  3. The User is obligated to not share their Wynajem-autokarow-warszawa.pl account with unauthorized persons. In the event of loss of the device on which the User uses the PayPal application and mobile payment services, or any other unauthorized use of the account by a third party, the Passenger is obligated to notify Wynajem-autokarow-warszawa.pl in writing to ul. Paprotki 6, 05-830 Rusiec, or electronically to biuro@wynajem-autokarow-warszawa.pl.
  4. In the case of cashless payment for the ride, payment confirmations will be sent electronically to the Passenger's email address provided during the ordering process. At the User's request, an invoice may be sent to the Passenger's email address or mailing address, which will be forwarded to the contractor at biuro@wynajem-autokarow-warszawa.pl or by traditional mail.
  5. Wynajem-autokarow-warszawa.pl reserves the right to exclude cashless payments in individual cases without giving a reason.

§3

Validity period

  1. The general terms and conditions of payment under the "Mobile Payments" service are valid for an indefinite period from the moment they are accepted by the User.
  2. Either party may cancel the mobile payment service at any time without providing a reason. Notice of cancellation must be submitted in writing via email to biuro@wynajem-autokarow-warszawa.pl.

§4

Payment Policy

  1. The Passenger undertakes to ensure sufficient funds are available in the account used for mobile payments. If insufficient funds are available in the account at the time of cashless payment, resulting in an unsuccessful attempt to debit the Passenger's or Customer's account, Wynajem-autokarow-warszawa.pl reserves the right to collect the due fees and costs in another form, such as a bank transfer or cash settlement directly with the travel service provider.
  2. Wynajem-autokarow-warszawa.pl is not responsible for the cashless payment process, including the process of charging credit cards or PayPal accounts. In the event of charging errors, billing errors, or payment system failures, the Passenger is required to contact the payment service provider or payment instrument issuer directly.
  3. Wynajem-autokarow-warszawa.pl reserves the right to charge interest for late payment by the Passenger in the amount of up to 5 percentage points above the NBP reference rate together with a handling fee of PLN 50 (in words: fifty zloty).
  4. In the event of damage caused by the use of an account that has previously been reported by the User for blocking, Wynajem-autokarow-warszawa.pl undertakes to cover the costs of the damage.

§5

Final provisions

  1. Wynajem-autokarow-warszawa.pl reserves the right to change these terms and conditions as part of the "Mobile Payments" service, notifying you of any changes on the website www.wynajem-autokarow-warszawa.pl. The current terms and conditions for the "Mobile Payments" service can be found on the main website www.wynajem-autokarow-warszawa.pl
  2. After receiving information about the change in the regulations of the "Mobile Payments" service, the Passenger may not consent to further use of the service, which results in the termination of the Passenger's rights to use the cashless payment option in the ordering panel.
  3. If a competent court or other authorized body finds any of the above-mentioned sections of the regulations to be invalid, voidable, legally ineffective, non-binding or unenforceable, it is assumed that the remaining parts will continue to be binding and applicable.
  4. The court with jurisdiction to resolve any disputes is the court with jurisdiction over the registered office of WarsawBusTravel.pl Sp. z o.o.
